Why CHO Policyholders Are Reaching Out to Us

Common reasons Community Health Options members contact us:

  • Prior authorization denials — CHO deems a doctor-recommended treatment “not medically necessary”
  • Out-of-network disputes — coverage conflicts when care was received outside CHO’s network
  • Retroactive denials — CHO reverses payment on a previously approved claim
  • Mental health & substance use denials — coverage that should be protected under federal parity law
  • Prescription drug denials — formulary exclusions or step therapy requirements delaying essential medications
  • Experimental treatment denials — rejections for procedures your physician recommends

Does ERISA Apply to Your Denial?

If you receive health insurance through your employer, your plan is almost certainly governed by ERISA — a federal law that sets strict rules for how insurers must handle claims and gives you the right to sue in federal court if benefits are wrongfully denied. Most employer-sponsored group plans in Maine and New England, including those administered through Community Health Options, fall under ERISA.

Don’t file your appeal alone. What’s submitted during the administrative appeal is often binding in federal court — having an attorney involved from the start can be the difference between recovering your benefits and losing them permanently.

Act Quickly — Deadlines Are Strict

ERISA imposes hard deadlines that, if missed, can eliminate your right to challenge a denial entirely. Standard appeals must typically be filed within 180 days of a denial — and urgent appeals may have shorter windows still.

If you received a denial letter from Community Health Options, the clock is already ticking.

Andrew Davis

Co-owner, Attorney
Andrew is one of the only long-term disability attorneys in the country who has spent years representing both large disability insurance companies and individual plaintiffs, a unique attribute benefiting his clients. He started his legal career at a boutique firm in New York City where he developed expertise in disability insurance and ERISA laws, while supporting individual plaintiffs in their fight to secure benefits. It is here that Andrew had an opportunity to win a precedent setting case in the field of disability law. After a few years, Andrew decided to make a geographic move, taking his experience to the state of Maine where he joined one of the best national disability firms in the country, supporting large disability insurers. Here he learned the craft from the insurers’ point of view, honing his knowledge of ERISA laws and developed a keen understanding of how large insurers approve or reject claims and the diligence necessary to win.
Dissatisfied with helping billion-dollar insurance companies and looking to return to his roots in the practice of disability insurance, Andrew joined a Maine-based firm. Here he used his extensive experience fighting insurance companies to create a significant national plaintiff’s practice dedicated to helping individuals secure the benefits they deserve. Andrew’s practice focused on individual care offering a high degree of personal availability to every client. Andrew routinely secured denial letters and claim files from insurance companies in support of his clients. Based upon these documents, Andrew developed an individualized plan for each client. This included supporting clients in developing initial claims and pursuing insurance companies through the appeal process, and if necessary, litigation to secure a just resolution, ensuring their clients were awarded deserved benefits.
Most recently, Andrew has built his own firm, Davis Law, LLC, where, his wife and partner, Meghan Connelly, an experienced federal trial attorney, could provide a more streamlined practice to help clients maximize their recovery against insurance companies. Andrew and his team have battled cases against every disability insurance company in the country. And, most importantly, given his defense experience, Andrew maintains excellent relationships with lawyers who work for insurance companies, and the lawyers who defend those companies in litigation. These connections foster a working relationship with the insurance companies that helps our clients maximize their recovery of benefits Andrew and his team have been highly successful in appeals forcing major insurers to pay millions of dollars to clients who were previously told they were not entitled to benefits. Once those claims are approved, Andrew and his team continue to manage their clients’ claims on an ongoing basis to protect their clients from future denials.
If we do not reverse a decision on appeal, Andrew often pursues our clients’ claims in federal court where most employee benefit claims are adjudicated. In the context of litigation, Andrew has secured millions of dollars in settlements for his clients. While many employee benefit claims settle, some do not in which case Andrew has achieved excellent results for our clients. Here are a few examples:

I was referred by another attorney to handle my long term disability denial for which attorney Davis had me reinstated right away. He handled the case with incredible sharpness, with thoroughness, obvious experience, dedication, producing stealth results. He was always very professional, compassionate and with a great sense of humor, easily approachable and responsive. I recommend him to anyone with no hesitation. He is great.
Donald
After being turned down by several attorneys, due to my case being small, Andrew stepped up to help me. With his help, we were able to hold my Long Term Disability provider accountable for the Insurance they claim to provide. He, and his assistant Angel, took the time to explain my legal options, as limited as they were, and guided me through the process painlessly. I can’t thank them enough for taking the time to help me, the “little guy.” If you need help with your long term disability provider, I highly recommend Andrew and his team.
